2. Who Can Use The Services.
You must be an individual 18 years of age or older to use the Services, and you must enroll to use the Services using our Sites or mobile applications. We reserve the right to refuse access to the Services or to cancel your account at any time without notice. By using the Services, you represent and warrant that any profile information you submit is true and accurate, that you are 18 years of age or older, and that you are fully able and competent to enter into and abide by these Terms. The Services are not intended for those under the age of 18. Use of the Services is void where prohibited.
Except as otherwise expressly provided in these Terms, the Services are for personal, non-commercial use only, and you represent and warrant that you are not using the Services on behalf of any third person or entity, nor for any commercial purpose. Limited commercial use of the Services is permitted, only as described in Section 3 below, by authorized representatives of companies, entities, or other organizations that are retailers, online sellers, or merchants engaged in ecommerce (“Merchant(s)”). If you use the Services on behalf of a Merchant, then you represent and warrant that you: (a) are an authorized representative of that Merchant with the authority to bind that Merchant to these Terms and (b) are bound by these Terms on behalf of that Merchant.
3. How the Services Work.
Available Savings Monitoring: We track customer policies at popular online Merchants. If we detect potential savings or refund opportunities based on your purchase history, we will either correspond with Merchants on your behalf using your name and email address to attempt to get you the benefit directly, or we will provide you with instructions on how you can contact the Merchant to obtain the benefit . Where Capital One Shopping corresponds with Merchants directly on your behalf, you authorize Capital One Shopping to act as your agent in performing this Service.
Our price drop Service monitors your eligible purchases for price reductions after you buy (“Price Drop Claim”).
From time to time, if we detect that your purchase was not shipped in the time and manner that a Merchant promised you, we may notify you of the claim opportunity or offer to correspond with the Merchant on your behalf and attempt to obtain a refund or other benefit for you (“Late Delivery Claim”). In order to receive a benefit, your purchase must meet the Merchant’s policy requirements. If you accept our offer to provide this Service, you agree that you will accept any resolution we obtain as final.
Not all purchases may be detected, and we are not responsible for any missed refund or compensation opportunities.
4. License and Restrictions
The Software you download consists of a package of components, which may include certain third-party software (“Third-Party Software””) provided under separate license terms (the “Third-Party Terms”). Your use of the Third-Party Software, if any, in conjunction with the Services in a manner consistent with these Terms is permitted, however, you may have broader rights under the applicable Third-Party Terms and nothing in these Terms is intended to impose further restrictions on your use of the Third-Party Software.
5. Product and Loyalty Account Information.
You understand and acknowledge that, through your use of the Services, you are authorizing and directing us to act on your behalf to collect, use, share, and store information from third-party Merchants and loyalty program providers for which you demonstrate interest during your activities on the Internet. This information includes, but is not limited to, product descriptions, pricing and shipping information, coupons and other discounts, and loyalty program credits or other purchase incentives earned in order to retain and share that information with Merchants and other users of the Services to perform and improve the Services.
